TERMS & CONDITIONS
INTRODUCTION
These terms and conditions apply to all accommodation and packages made available by Bird Textiles Pty Ltd as Trustee for Bending Family Trust t/a Bird’s Nest Studio (hereafter ‘Bird’s Nest Studio’) through the property Bird’s Nest Studio. By making a booking for accommodation or packages, the guest warrants they have read these terms and conditions and agree to be bound by them subject to such changes as are notified to them. If the booking for accommodation and/or packages is made through a third party, the terms and conditions of that third party also apply.
SOLO RETREAT
Bird’s Nest Studio is a solo retreat space. One adult only.
Bookings for more than one person may be considered in special circumstances, and/or for an NDIS STA guest bringing disability support worker.
Visiting guests for long term residencies by prior arrangement only.
Registered guest only.
HOUSE RULES
Check-in is from 12pm onward.
No pets allowed.
Bird’s Nest Studio is a smoke free accommodation. No smoking (including vaping) inside Bird’s Nest Studio or out on the deck/studio area.
If any damage or issues arise during your stay, it is important to communicate them to the Bird’s Nest Studio team as soon as possible.
Upon check out of Bird’s Nest Studio, please leave it in a neat and tidy condition.
Check-out is by 12pm.
PAYMENT POLICY GENERAL
All bookings (except NDIS STA bookings) are subject to a non-refundable 50% prepayment by bank transfer at the time of reservation. An invoice will be issued on receipt of booking enquiry by email.
The balance of the booking will be invoiced for payment within 28 days of a confirmed stay.
Bookings made within 28 days of a stay will be invoiced 100% of the booking fee.
A booking confirmation email must be obtained. If a booking confirmation email is not obtained, the booking is not confirmed.
It is the responsibility of the guest to review the booking confirmation email and promptly advise Bird’s Nest Studio if there are any errors or misunderstandings.
PAYMENT POLICY NDIS STA RESPITE
All NDIS participant STA Respite bookings require confirmation, in writing, at the time of reservation, from either the participants NDIA Planner, Local Area Coordinator or Plan Manager, that the funding has been approved and payment will be received in full at the completion of the stay. An invoice will be issued on receipt of confirmation
A booking confirmation email must be obtained. If a booking confirmation email is not obtained, the booking is not confirmed.
It is the responsibility of the guest to review the booking confirmation email and promptly advise Bird’s Nest Studio if there are any errors or misunderstandings.
CANCELLATION POLICY GENERAL
Where a booking is cancelled before 5pm, 28 days prior to the arrival date, only the 50% deposit for that booking will be retained.
No refund will be granted in the event a guest does not arrive for their booking or cancels on the date of their booking.
A cancellation confirmation email must be obtained. If a cancellation confirmation email is not received, the booking remains in effect.
The liability of Bird’s Nest Studio arising from any cancellations of accommodation or packages by Bird’s Nest Studio or a third-party operator is limited to the amount paid for the cancelled booking.
We encourage our guests to purchase travel insurance to cover any unforeseen circumstances.

Where a booking is cancelled after 5pm, 7 days prior to the arrival date, or later, the guest will be billed in full.
In the event a guest does not arrive for their booking or cancels on the date of their booking they will be billed in full.
A cancellation confirmation email must be obtained. If a cancellation confirmation email is not received, the booking remains in effect.
The liability of Bird’s Nest Studio arising from any cancellations of accommodation or packages by Bird’s Nest Studio or a third-party operator is limited to the amount paid for the cancelled booking.
We encourage our guests to purchase travel insurance to cover any unforeseen circumstances.
DAMAGE POLICY & EXCESSIVE CLEAN UP FEES
Upon departure and the return of all keys, Bird’s Nest Studio will be inspected and audited.
The guest will be invoiced the total cost in the following circumstances:
Any item is stolen or removed from the premises;
There is any damage caused to Bird’s Nest Studio property, by the guest or anyone invited onto the property by the guest. Examples include but are not limited to any breakage, damage or excess cleaning requirements;
Paint, or other damages from use of art materials;
Smoking and/or vaping inside Bird’s Nest Studio and/or out on the deck;
The guest breaches any of the listed Terms and Conditions.
Any damage loss or expense incurred as a result of your breach of these Terms & Conditions will be invoiced. If payment is not received within 7 days, the matter will be referred to police and charges will be laid.
THE STUDIO LARDER
The Studio Larder is defined as all food and drinks provided in the Bird’s Nest Studio, as part of an all-inclusive package. If the guest has booked an all-inclusive package a larder selection list will be provided on receipt of balance of the booking and must be completed and returned at least 7 days before arrival.
ACCOMMODATION
All accommodation is subject to availability. Bird’s Nest Studio will endeavour to provide the accommodation but reserves the right to refuse requests for bookings or actual bookings.
Rates are per night based on one-person occupancy. Maximum occupancy per retreat is one person.
MINIMUM NIGHT STAYS/CHECK-IN
Unless otherwise agreed/stated, Bird’s Nest Studio generally requires a four-night minimum stay.
Earlier parking (before 12pm) on the day of check-in must be requested and pre-arranged and is subject to availability. Parking after check-out is not permitted without prior arrangement with the Bird’s Nest Studio team.
All guests will receive a personalised check-in email prior to arrival with check in details and directions to Bird’s Nest Studio after the balance of their stay has been processed. Guests will be met onsite and shown through the property. All-inclusive package guests will be met at the Coolangatta/Gold Coast Airport, if required.
WILDLIFE
The abundant wildlife is a very special part of staying at Bird’s Nest Studio. We do not guarantee that you will see all of the listed varieties during your visit, because the creatures are free and wild. It is, however, rare to not see many of them over a few days at Bird’s Nest Studio. The black swans generally frequent the riverside every week or so. Dolphins are usually spotted around once a month. Guests interact with the wildlife at their own risk.
SIGNIFICANT FLOOD LOCATION
Bird’s Nest Studio is situated on the Tweed River. We have a flood plan in place in the unlikely event of a flood occurring.
FIRE SEASON
During Total Fire Ban season you cannot light, maintain or use the outdoor firepit at Bird’s Nest Studio, or carry out any activity in the open that causes, or is likely to cause, a fire. For further information please check advice on the RFS website.
BIRD’S NEST STUDIO BIKE USAGE
Bike includes helmet, lock, spare tube, pump and tire levers. The guest accepts responsibility for any loss or damage to the equipment and fittings on the bike save for regular wear and tear. This includes, but is not limited to: damaged tires, inner-tubes, wheels, grips, structural bike-frame damage and damage to components fitted to the equipment. The replacement costs will be invoiced to the guest. Bird’s Nest Studio accepts no responsibility or liability pertaining to the guest’s health and physical fitness, riding capability, injury or damage to the guest or any 3rd party persons or property arising from the use of Bird’s Nest Studio’s bike. Bird’s Nest Studio warrants the bike supplied is done so in a serviceable condition and is fit for purpose.
